										<content:encoded><![CDATA[<div class="nolwrap"><p>Privacy is important, especially when it comes to your money. There are certain personal financial details Kiwis don’t want falling into the hands of hackers, or for that matter their partners, children, employers and others. Some things are just personal.</p>
<p>Most reputable Kiwi organisations do their best to stay within laws such as the Privacy Act, Human Rights Act, and others. However there are a whole heap of ways they can breach your privacy.</p>
<p>But first, you need to understand the concept of “authorised disclosure”. When you agree to the terms and conditions of all sorts of credit, which can include utility and mobile phone accounts not just loans, you usually agree to “authorised disclosure”, which means you allow your data to be shared in specific ways.</p>
<p>For example, when you take out insurance, the terms and conditions say that details of your claims can be lodged on an Insurance Claims Register, that other insurers can access and view. Another way you might authorise that disclosure is in the fine print of an employment contract.</p>
<h2>Signing away your privacy</h2>
<p>Some of the areas where you might want to consider your privacy include:</p>
<ul>
<li><strong>Credit reports.</strong> Whenever you apply for credit you agree for certain aspects of your data to be shared with credit reporting agencies illion, Equifax, and Centrix. That date can be viewed by other lenders, employers and landlords. You have the right to view the private information held about you by these agencies and ask for it to be corrected. But <a href="https://www.creditsimple.co.nz/content/help-want-delete-credit-history/">you can’t get it deleted</a>.  There is a Credit Reporting Privacy Code and if you think the credit reporter has been naughty you can complain to the Privacy Commissioner. Credit Simple isn’t a credit reporter but we’re owned by one – <a href="http://www.illion.co.nz">illion</a> – and we’re careful to make sure we do all the right things.</li>
<li><strong>Insurance Claims Register.</strong> This register is run by the Insurance Council of New Zealand  and is designed to detect and prevents fraud, such as purposeful non-disclosure and double dipping. This is a little scary because if your name is flagged for fraud on the ICR it can be extremely difficult to get insurance of any kind, and as a result, take out a mortgage.</li>
<li><strong>Banks and finance companies.</strong> Banks know an awful lot about you and me. They know where you shop, how much money you earn, where you invest and sometimes even your net worth (how much you own or owe). Some of the most common issues (albeit rare) faced by bank customers often relate to ex-partners being given access to statements.</li>
</ul>
<h2>Real life privacy breaches</h2>
<p>The Privacy Commission, Insurance &amp; Financial Services Ombudsman (IFSO), and Banking Ombudsman, and other agencies hear cases related to breaches of individuals’ privacy. Some examples include:</p>
<ul>
<li><strong><a href="https://bankomb.org.nz/news-and-publications/case-notes/item/case-8057" target="_blank" rel="noopener">Put in harm’s way.</a> </strong>A bank customer changed her name by deed poll to escape a violent relationship. The bank started sending her statements with her new name to the ex-partner. The Banking Ombudsman recommended the bank pay for the costs of the installation, maintenance and monitoring of a security alarm at her new address for three years, the costs of installation of security lighting and a fence for the woman’s property, which cost approximately $11,000.  The bank paid her an additional $4,000 for “inconvenience”.</li>
<li><strong>Sent to debt collectors.</strong> Financial organisations can disclose your information to a debt collector about a debt you owe. But where it’s disputed they need to tread carefully. The Privacy Commission cites the example of <a href="https://privacy.org.nz/blog/taylor-v-orcon/" target="_blank" rel="noopener">the Taylor v Orcon case</a>. In this case telecommunications company Orcon failed to take reasonable steps to check the information and simply sent Mr Taylor’s bill to a debt collector despite the fact he had disputed it.  In that case the commission found Orcon was in breach of Principle 8 of the Privacy Act information.   Orcon’s actions resulted in Mr Taylor being declined credit and refused a tenancy.</li>
<li><strong>Blamed for her husband’s fraud.</strong> Mrs G complained to the IFSO because her name had been included in an alert on the Insurance Claims Register as a result of her husband’s fraud. She said it was unfair to have her name associated with the alert on the ICR, because she had nothing to do with the claim. Because it was a jointly held policy the alert could not be removed. “The policy stated that joint policyholders are deemed to act with the expressed authority of each other,” the Ombudsman noted.</li>
</ul>
<p>It’s easy in the digital age to give too much information away voluntarily on social media as well. So guard your financial privacy well.</p>

			<p>Did you know how landlords score you and why you should care? We caught up with Ian Barker, managing director of Tenant Information NZ (TINZ), to answer some frequently asked questions about your information, privacy, and rights, and how tenants can view their file.</p>
<h3>Tell us about TINZ and how my landlord might use it?</h3>
<p>TINZ is a tool developed for landlords to help landlords and property manager screen tenants.  The search returns data from 15 different databases and uses verified data to automatically calculate a tenant risk score from 0 to 1,000. Landlords use the results to help decide who would be the best tenant for their property. If your score is low, so are your chances of landing the rental.</p>
<h3>Where does the information come from?</h3>
<p>Since it launched in 1998 TINZ has collected hundreds of thousands of Tenant Rating Reports from landlords and holds them for six years. In addition the TINZ algorithm looks at credit bureau data from <a href="http://www.illion.co.nz" target="_blank" rel="noopener">illion</a> (Credit Simple&#8217;s parent company). The report also gives landlords a variety of public information held on third-party websites. This includes government databases, insolvency information, Tenancy Tribunal hearings, court judgements, Companies Office records, Police Ten 7, Parole Board, Sensible Sentencing Trust, NZ Gazette and obituary results.</p>
<h3>Why does a landlord need to know this information?</h3>
<p>Landlords don’t want to delve into your private life. But they trust you with an asset worth hundreds of thousands of dollars and want to know you’ll look after it. They also need to know the rent will be paid so that they in turn can pay their mortgage at the end of the month. If you don’t pay the rent, the property is damaged or the neighbours start complaining, the landlord has a problem.</p>
<h3>What about privacy?</h3>
<p>If your landlord or property manager uses TINZ the tenancy application form will have a privacy statement asking your permission to make checks. You don’t need to agree to the search being done on you, but you might risk not getting the tenancy if you do this. Everyone has a right to see the report and correct any information. TINZ is committed to meeting all aspects of New Zealand’s Privacy Act. If you want to know what information is held about you on the TINZ database, use the tenant enquiry process on the TINZ website that anyone can use.</p>
<h3>Can I see my score?</h3>
<p>You can request TINZ to send you whatever is held on the TINZ database for free. And yes, you can see your score but the score algorithm brings in third-party data so that incurs a small cost. To take <a href="https://www.tinz.net.nz/tenantnet/tinz/tenant-check-self.jsp" target="_blank" rel="noopener">the free TINZ check-up</a> you need to upload a copy of photo identification and fill in some identification details such as full name and date of birth. Your report will be returned within five business days.</p>

			<h3>What about the publicly held data?</h3>
<p>TINZ also allows individuals to search the third party databases used to produce the score, but not held by TINZ. It costs $17 plus GST to do this search.  This report can be run instantly if you have a valid passport or driver’s license.</p>
<h3>Why should I get my report?</h3>
<p>It’s important to know what data about you is held on the internet. Tenants who go through this process sometimes find old debts they’d forgotten about, or they find debts associated with a former partner. Another common scenario is a black mark from debt that has been written off, which isn’t a good look. Despite the write-off this information remains on your credit file unless you pay off the debt and ask the credit provider to clear it.</p>
<h3>What if there’s something wrong in my data?</h3>
<p>If there is a problem with the data held by TINZ then you need to go through the <a href="https://www.tinz.net.nz/tenantnet/tinz/tenant-check-self.jsp" target="_blank" rel="noopener">tenant enquiry process</a> to have it corrected in accordance with the Privacy Act. You&#8217;ll need to provide evidence that the information is incorrect. If the data comes from the third-party databases, you need to contact them directly to have the information corrected.</p>
<h3>What if I’m not perfect?</h3>
<p>You don’t have to be squeaky clean. Landlords know that most tenants have some sort of consumer debt. If, however, you appear to be up to your eyeballs with too many hire purchases accounts or other debt landlords might surmise that you may not have sufficient income to pay the rent.</p>

<div><strong>A lot of people think they don&#8217;t have a credit history at all,</strong> because they&#8217;ve never had anything on hire purchase or used a credit card. But actually, your credit history includes a lot of other things such as power and phone accounts, mobile phone and internet, and personal loans.</div>

<div><strong>It&#8217;s actually really hard to get a perfect credit score of 1,000</strong> &#8211; you have to work up to it. Many people think they start off with a perfect score and they&#8217;ll only go down if they miss paying their bills, but it&#8217;s also about regularly and responsibly making payments. Even getting above 900 means you&#8217;re into credit unicorn territory &#8211; only 9.2% of Kiwis have a score above 900.</div>

<div><strong>If you&#8217;ve got a good credit score, you should be asking for a better deal,</strong> because you&#8217;re the kind of customer companies want to deal with. Our research shows only 15% of Kiwis have used their credit score to get a better deal, but 60% would change their financial institution if they got a better rate. Go out there and ask for discounts and cheaper rates &#8211; and if you don&#8217;t get them, switch.</div>

<div><strong>Defaulting on your bill payments will hurt you more than you realise.</strong> We often talk to people who are surprised they&#8217;ve got a credit score of zero when they haven&#8217;t had something seriously bad, such as a bankruptcy, happen. But not paying your bills &#8211; or paying them late &#8211; is one of the worst things you can do for your credit score.</div>
